For AI-generated audio, separate three questions: who supplied the human creative work, what license your generator grants, and what the platform you publish on requires. In the United States, the Copyright Office says material generated entirely by AI is not copyrightable; prompts alone do not make you the author. A mixed work can protect only its human-authored parts, and registration applicants must disclose more than a minimal amount of AI-generated material and describe their contribution.

What You Can Safely Claim About Ownership

A paid subscription can give you contractual rights to use a track even when copyright protection is limited. That contract is different from owning copyright. Keep the generation date, plan name, prompts, uploaded source files, edits, stems and the vendor’s terms version so you can show what you contributed and what license you received.

  • Copyright status: Entirely AI-generated audio is not copyrightable under the Copyright Office’s January 29, 2025 report. Human-written lyrics, melodies, performances, arrangement or substantial editing may be protectable to the extent they are genuinely human-authored.
  • Registration: If the work contains more than a minimal amount of AI-generated material, disclose that material and describe your human contribution when applying to register it.
  • Contract rights: A service’s commercial license, download permission or ownership language comes from its plan terms. Read the current terms for the exact account and date you used.

Consent Rules For Voices, Covers And Source Audio

Voice Impersonation

Do not clone or imitate an identifiable person’s voice without permission. Spotify said in September 2025 that vocal impersonation is allowed only when the impersonated artist has authorized it. YouTube also requires disclosure when realistic altered or synthetic content could be mistaken for a real person’s performance. Keep written consent and disclose synthetic performance where the destination requires it.

Covers And Samples

A generator’s license does not automatically clear a composition, recording, sample or uploaded vocal that you did not create. Before releasing a cover, remix or track built from uploaded audio, identify every underlying right and check the generator’s terms and the release platform’s rules. The products below do not establish a universal cover or sample clearance.

Commercial Releases

Commercial permission varies by product and plan. Treat free, personal-use, attribution, watermarked and non-commercial labels as real restrictions until the vendor’s current terms say otherwise.

AI Music Products And Their Stated Rights

Product What The Listed Terms Say Legal Check Before Release
Suno Paid subscriber songs are yours to keep and use; the Free Plan does not include commercial rights. Confirm you were on a paid plan when creating the track and retain the plan record. Suno’s Free Plan also lacks stem separation.
Eleven Music Tracks are cleared for broad commercial use, but commercial rights vary by subscription tier and exclude film, TV and studio games. Match the intended use to your tier; check the terms before audiovisual, broadcast or game release.
Loudly The service advertises a commercial license and 100% royalty-free music. Paid licensing rights depend on plan terms. Save the plan and license covering the download; verify whether your distribution use is included.
Musicful Music created with Musicful can be used commercially. Downloads receive a non-exclusive perpetual license, while Musicful retains ownership; commercial use is limited to Standard/Pro plans. Use Standard or Pro for commercial work and keep the license evidence. The license is non-exclusive.
Songin.ai Free downloads are watermarked MP3 files for personal use only; its stated rights include “No commercial rights” for restricted use and “Full commercial rights” where the applicable plan grants them. Identify the exact plan before publishing and confirm that multitrack stem exports, if needed, require Premium.
Tunee Free users may use music for personal projects with attribution. Tunee also states that every generated song and video comes with a full commercial license, while warning that copyright law is still evolving. Resolve the free-plan attribution and commercial-license wording against the current terms before release.
AI Jingle Maker Every jingle includes commercial usage rights for broadcasts, podcasts, sponsor audio and audio marketing. Check whether your planned use is one of the listed categories and retain the jingle license record.
OpenMusic AI Tracks are designed for commercial use and supplied with a license for proof and protection, including stated readiness for YouTube, Spotify, TikTok and other platforms. Download and store the license with the final file; plan terms govern downloads and commercial licensing.
Soundverse AI Beat Maker Beats are described as royalty-ready, with a commercial license available for releasing and monetizing tracks. Confirm the commercial license attached to your account and the exact beat or stem you downloaded.

A Rights-Safe Generation Workflow

  1. Define the use: Write down whether the audio is personal, monetized social content, a podcast, advertising, a broadcast, a film, television, game or streaming release. Rights can change with the use and plan.
  2. Choose a plan with matching permission: For example, do not use Suno’s Free Plan for a commercial release, and do not use Musicful’s Free/Basic access for commercial work.
  3. Use owned or permissioned inputs: Upload only vocals, recordings, lyrics, melodies, samples and reference audio you created or are authorized to use. Keep the permission with the project.
  4. Prompt for an original brief: Example: “Create a 30-second instrumental electronic bed for a technology podcast, 100 BPM, clear intro and outro, no named artist, no recognizable song reference, leave space for narration.” This describes a need without asking for a person’s identity or a specific protected recording.
  5. Record human contributions: Save your own lyrics, melody revisions, arrangement decisions, performances, edits and mix notes. These are the parts you may need to identify in a copyright application.
  6. Export and archive: Keep the source prompt, generation ID if supplied, stems, final mix, plan invoice, license page and terms date. Ask the vendor whether a later plan upgrade changes rights for an earlier generation.
  7. Check the destination: Apply Spotify’s authorization and AI-credit expectations, and use YouTube’s altered-or-synthetic disclosure when realistic synthetic performance could be mistaken for a real person.

Platform Checks Before You Publish

Spotify

Spotify announced protections against unauthorized vocal impersonation, spam and duplicate mass uploads, and support for DDEX AI disclosures in credits. In August 2026 it added an “AI Persona” badge for artist identities that may be AI-generated. Obtain authorization for an impersonated voice and provide accurate AI credits.

YouTube

YouTube’s July 2025 “inauthentic content” monetization policy targets mass-produced, repetitive or template-based uploads rather than AI use by itself. Its July 2026 clarification groups generic or repetitive content and AI personas discussing sensitive topics among the covered areas. Disclose realistic altered or synthetic content through YouTube’s label when viewers could mistake it for a real person’s performance.

Practical Prompt And Project Examples

Podcast Bed

Use a prompt such as: “Instrumental ambient technology bed, 45 seconds, gentle pulse, no vocals, clean ending for a spoken-word edit, entirely original motif.” Confirm the plan permits monetized podcast use, then keep the rendered file and license.

Brand Jingle

Write the brand’s own words and melody, then request: “Ten-second upbeat jingle using these original lyrics, two alternate endings, clear pronunciation, no imitation of any singer.” AI Jingle Maker states commercial rights for broadcasts, podcasts, sponsor audio and audio marketing; verify that your campaign fits those categories.

Human-Edited Song

Start with your own lyrics and a recorded guide melody, ask for an instrumental arrangement, then replace or edit sections yourself. Archive the guide, edits and final stems so the human contribution is identifiable. A generated backing track remains subject to the selected product’s plan terms.

When To Stop And Get Specialist Advice

Pause publication and obtain qualified legal advice when a project involves an identifiable person’s voice, a disputed sample or cover, a label or commissioned client demanding copyright ownership, a film, television or studio-game placement, or a takedown or infringement claim. The sources here establish product terms and platform policies; they do not resolve a dispute or guarantee copyright protection.
