Using an AI voice in a song does not by itself make the result fair use or clear the rights to the voice, song, or recording. Get consent to use a real person’s voice, check the AI service’s terms, and treat a cover as a separate rights question from the generated vocal. A tool’s commercial-use claim is not proof that every element in a track is cleared.
What Rights Questions Should You Separate?
- The voice: If the output imitates an identifiable person, get that person’s permission. Spotify announced on September 25, 2025 that vocal impersonation is allowed only when the impersonated artist has authorized it. - The song: Replacing a singer does not answer whether you may use the underlying composition. The facts here do not establish that an AI cover is fair use or that a platform’s commercial-use claim clears the song.
- The recording: A YouTube link or an uploaded track can involve a separate recording from the composition. A voice swap does not, by itself, establish permission to use either.
- The AI-generated contribution: The U.S. Copyright Office says works generated entirely by AI are not copyrightable, prompts alone do not make someone the author, and only human-authored parts of a mixed work may be protected. For registrations containing more than a minimal amount of AI-generated material, applicants must disclose it and describe the human contribution. Does Fair Use Let You Clone A Singer Or Make A Cover?
There is no blanket fair-use answer established here for cloning a singer, making a cover, or swapping a vocal in an existing recording. Calling a track an experiment, tribute, parody, or AI transformation does not establish that it is fair use. The available facts do not set out a fair-use test or resolve any particular use, so do not treat a tool’s output or license language as a legal ruling.

For a lower-risk creative workflow, use your own voice or a vocalist who has agreed to the use, and build a new song rather than starting from an existing recording. If you want a recognizable person’s voice or an existing song, obtain the relevant permissions and check the service and destination platform’s current terms before publishing. How Can You Make A Voice Track With Clearer Inputs?
- Choose the voice first. Use your own voice, a vocalist who has agreed to the specific use, or a service-provided vocal option. Keep a record of what the person agreed to, including whether the track may be distributed or used commercially.
- Write for the voice, not around an imitation. Try a prompt such as: “Create an original, intimate verse and chorus about leaving home; use a warm, restrained vocal, clear diction, and a gradual rise in intensity.” This specifies musical direction without naming a singer to copy.
- Keep the song and recording separate from the voice decision. For an original track, write new lyrics and use newly generated or otherwise cleared musical material. For a cover or vocal swap, identify what song and recording you plan to use, then check their permissions independently.
- Check terms at the point of release. Confirm that the service’s current terms cover your intended use and that you have consent for the voice and permissions for other material. Product descriptions do not establish every right in your finished track.
What Do Spotify And YouTube Require Or Signal?
Spotify announced support for DDEX AI disclosures in credits and an AI Persona badge in August 2026 for artist identities that may be AI-generated rather than real people. Its earlier announcement said it would permit vocal impersonation only with the impersonated artist’s authorization.
