Making AI music is not automatically illegal. In the United States, the act of generating a song with an AI service is generally different from owning copyright in that song. The U.S. Copyright Office says material generated entirely by AI is not copyrightable, a prompt alone does not make you the author, and only human-authored parts of a mixed work can be protected. If you register a work containing more than a minimal amount of AI-generated material, you must disclose that material and describe your human contribution. The Copyright Office’s Part 2 report explains those positions.
So the practical answer is: creating AI music can be lawful, but publishing or monetizing it can still create problems if you use someone else’s voice, lyrics, recording, samples, identity, or platform account in an unauthorized way. A service’s commercial-use license also does not turn fully AI-generated output into guaranteed copyright-protected music.

Copyright In The Finished Track
A song can contain both machine-generated and human-authored material. Your original lyrics, recorded guitar, arrangement decisions, edits, and other creative contributions may be protectable; the entirely AI-generated passages may not be. Keep project files, prompts, source recordings, and edit history so you can describe what you contributed if a distributor, platform, or registration application asks.
Voices, Names, And Consent
Voice cloning and vocal imitation are the clearest consent issue. Do not ask a generator to sound like a living singer, imitate a recognizable performer, or reproduce a private person’s voice unless you have the necessary permission and the service allows that use. Spotify said in September 2025 that vocal impersonation is allowed on its service only when the impersonated artist has authorized it. Spotify also introduced an AI Persona badge in 2026 for artist identities that may be AI-generated. These policies can affect distribution even when the audio file itself was generated legally. Spotify’s AI-protection announcement and its AI Persona update describe those changes.

Uploads, Samples, And Covers
Only upload audio, lyrics, or reference material that you own or have permission to use. A prompt such as “a new song with this mood” is materially safer than uploading a commercial master and asking for a near-duplicate. If you make a cover or use a recognizable composition, separate the service’s generation terms from the permissions needed for the underlying song and recording. The platform’s terms control what it accepts and what rights it grants; check them before release.
How To Make AI Music More Safely
- Start with original material. Write your own lyric, record your own reference performance, or describe a mood, tempo, instruments, structure, and occasion without naming another artist.
- Use a consent-safe prompt. For example: “Create an original two-minute instrumental for a technology explainer video: restrained electronic pulse, warm piano, no vocal, no quotation of existing melodies, clear intro and loopable ending.”
- Review every output. Reject generations that contain a recognizable lyric, melody, voice, or sample. Do not assume a prompt makes an accidental similarity lawful.
- Add human authorship where you can. Rewrite lyrics, perform an instrument, arrange sections, edit transitions, and mix the track yourself. Keep those source files.
- Check the exact plan terms before publishing. Confirm whether your plan permits commercial use, downloads, distribution, attribution, and the intended platform. A free tier may be personal-use only.
- Disclose when a destination requires it. YouTube requires disclosure for realistic altered or synthetic content that could be mistaken for a real person’s performance. YouTube’s inauthentic-content policy targets mass-produced, repetitive, template-based uploads rather than AI use by itself. YouTube’s clarification describes the disclosure and inauthentic-content categories.
Which AI Music Services State Commercial Rights?
The following is a rights-focused reading of the supplied service information. “Commercial rights” means the vendor states a permission; it does not promise copyright protection or override a platform’s rules.

| Service | Stated rights or restriction | What to verify before release |
|---|---|---|
| Suno | Paid subscriber songs are yours to use; the Free Plan does not include commercial rights. | Use the plan active when the song was created and review its current terms. |
| Eleven Music | Tracks are cleared for broad commercial use, but commercial rights vary by subscription tier; the free plan is personal use. | Confirm your tier and exclusions, including stated limits for film, television, and studio games. |
| Soundverse AI Beat Maker | The service says beats are royalty-ready and that a commercial license is available; Creator & Pro lists commercial licenses. | Check which plan supplies the license for your release and whether your uploaded material is cleared. |
| Loudly | It describes its music as royalty-free and commercially licensed; paid licensing rights depend on plan terms. | Read the plan license for streaming, client work, advertising, and distribution. |
| Mureka | It says downloaded tracks can carry full commercial rights across platforms and projects. | Confirm that the download and account plan you use includes those rights. |
| Musicful | Downloads receive a non-exclusive perpetual license for content and monetization; the service retains ownership, and commercial use is limited to Standard/Pro plans. | Keep the license certificate and verify that your plan is Standard or Pro. |
| Songin.ai | Paid-plan music is stated as commercially usable; free downloads are watermarked MP3 files for personal use only. | Use a paid-plan export for commercial publishing and retain the plan evidence. |
| Tunee | Paid subscribers receive full commercial rights; free users have personal projects with attribution. | Add the required attribution on free projects and check the current subscriber terms. |
Prompts And Workflows That Reduce Trouble
Original Background Music
Describe function rather than a famous reference: “Create a calm, original instrumental bed for a six-minute software tutorial, light percussion, soft synth pad, no vocal, no sampled melody, 90 BPM, with a clean four-bar ending.” Then make your own arrangement edits and document them.
Human-Led Songwriting
Write the chorus yourself and ask for several accompaniment ideas without naming an artist: “Keep these original lyrics unchanged; suggest three contrasting chord and rhythm directions for an acoustic pop chorus.” Perform or record the final vocal yourself if the identity matters.

Voice Experiments
Use your own voice or a voice actor who has agreed to AI processing. Ask the service how consent, retention, training, and publishing are handled. If those terms are not clearly stated, do not upload the voice for a commercial release.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. When You Should Stop And Check The Terms
- You want to imitate a named artist or clone a recognizable voice.
- You plan to upload a commercially released song, sample, or lyric you did not create.
- You need a guarantee of copyright ownership rather than a contractual license to use a file.
- You are distributing at scale, where Spotify’s spam controls or YouTube’s inauthentic-content rules may apply.
- A service does not state the commercial, attribution, download, or platform rights your project requires.
AI music is therefore best treated as a tool with conditions: generate from material you can use, add and preserve human contributions, obtain consent for voices and identities, and verify the exact vendor and destination rules before release.
