You can make original AI music without borrowing a song, lyric, sample, or recognizable voice, but “copyright-free” is not a guarantee that a track is free of all rights or cleared for every use. In the United States, the Copyright Office says music generated entirely by AI is not copyrightable; prompts alone do not make you its author. Human-authored contributions to a mixed work may be protected. Treat originality, the generator’s license, and your intended use as separate checks.
What “Copyright-Free” Can Mean
For a practical project, aim for a track made from your own prompt and lyrics, with no unlicensed source audio or imitation of a real artist. Then check the generator’s terms for permission to use the output where you plan to publish it. A vendor’s commercial-use license and copyright ownership are different questions; the product details here do not establish that an output is cleared for every use.

Choose a Generator Based on the License You Need

Make a Track From a Clean Starting Point
- Define where the music will go. Write down the format and use: for example, an original instrumental bed for your own explainer video. This helps you decide whether you need a license that permits commercial use.
- Write a self-contained prompt. Describe the mood, energy, arrangement, and intended length in your own words. For example: “Create an original instrumental bed for a short technology explainer: calm and curious, a gentle pulse, sparse percussion, a warm low layer, and a simple melody that leaves room for speech. No vocals, no samples, no recognizable melodies.” This is a prompt example, not a guarantee that a particular tool supports every musical detail.
- Keep source material yours or authorized. Use original lyrics if you add vocals. Do not upload a commercial recording, use someone else’s lyrics, or ask for a real artist’s voice without the necessary permission. If you use a voice, sample, or reference audio, check the generator’s rules and obtain consent where needed.
- Generate and revise from your own description. If the result resembles a known recording or voice, discard it and revise the prompt toward more distinctive musical choices. Do not assume a generator can determine whether an output infringes someone’s rights.
- Save the evidence of your choices. Keep your prompt, edits, generation date, selected plan, and a copy of the applicable terms or license. This record can help you explain what you contributed and what permission you relied on; it does not itself grant rights.
- Check the destination’s rules. YouTube requires disclosure for realistic altered or synthetic content that could be mistaken for a real person’s performance. Its inauthentic-content policy targets mass-produced, repetitive, or template-based uploads, not AI use as such. Spotify says vocal impersonation is allowed only when the impersonated artist has authorized it. Review the current platform rules before uploading: YouTube policy clarification and Spotify’s AI music policy announcement.
What You Can—and Cannot—Call the Result
“Original AI-generated music made without borrowed source material” is a more precise description than “copyright-free.” In the United States, entirely AI-generated music is not copyrightable under the Copyright Office’s stated position, while human-authored parts of a mixed work may be protected. The generator’s terms still matter for permitted use, and this guidance does not establish the legal status of a particular track outside those stated facts.
